Welcome to Spokenly. By accessing or using our application and services, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please do not use our services.
1. Description of Service
Spokenly is a speech-to-text dictation application for macOS. The app provides voice transcription using both local on-device models and cloud-based AI services. Some features require an active subscription.
2. Acceptable Use
You agree to use Spokenly only for lawful purposes and in accordance with these Terms. You may not use the service to process, transcribe, or generate content that is illegal, harmful, abusive, or violates the rights of others.
3. Subscriptions and Payments
Spokenly offers subscription plans that provide access to premium features. Payments are processed by our payment partner, Polar, who acts as the Merchant of Record for all transactions. Polar handles billing, invoicing, and applicable sales taxes on our behalf.
Purchases made through the Apple App Store are governed by Apple's terms and conditions.
4. Refunds
Refund requests for purchases made through Polar are handled directly by Polar in accordance with their refund policy. For App Store purchases, refunds are managed by Apple through their standard process.
5. Intellectual Property
Spokenly and its original content, features, and functionality are owned by Spokenly and are protected by copyright and other intellectual property laws. You retain ownership of any content you create using the service, including your transcriptions.
6. Disclaimer of Warranties
Spokenly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that transcriptions will be completely accurate, uninterrupted, or error-free.
7. Limitation of Liability
To the fullest extent permitted by law, Spokenly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service.
8. Termination
We reserve the right to suspend or terminate your access to the service at our discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or our business.
9. Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated "Last Updated" date. Continued use of the service after changes constitutes acceptance of the revised Terms.
